Established by Congress in 1990, the program offers a path to permanent residency for foreign investors who invest in new commercial enterprises that create or preserve a minimum number of jobs for U.S. workers. Unlike other visa categories that might focus on employment or family reunification, the EB-5 visa is centered around investment and job creation.

The EB-5 program not only paves the way for investors and their immediate family members to gain a green card, but it also contributes to the U.S. economy by generating employment opportunities. After the conditional period of two years, if the investment is proven to have met the job creation requirements, the investor can then apply to have the conditions removed, solidifying their status as permanent residents of the United States.

BASIC EB-5 GREEN CARD ELIGIBILITY REQUIREMENTS:
  • Applicants must commit capital to a business project that directly creates or preserves at least ten full-time jobs for qualifying U.S. workers.

  • The investment must be in a business that is structured to make a profit and registered for operation within the United States.

  • The investor must prove that the invested funds were legally obtained.

  • The applicant must be 18 years of age.

PERMANENT U.S. RESIDENCY REALIZING THE DREAM

ELIGIBILITY

After two years of holding a conditional green card, EB-5 investors are required to file an I-829 petition with USCIS to remove the conditions and transition to permanent residency. The EB-5 program ultimately provides a pathway to citizenship, with eligibility for naturalization arising after 5 years of permanent residency in the United States.

This journey begins with a two-year conditional Green Card, reflecting the investor's commitment and contributions, and culminates in the attainment of permanent residency.

PROCEDURE

After two years, the investor submits Form I-829 to validate that the project has fulfilled all the job creation requirements and that the investor has fulfilled all the obligations of being a U.S. resident in good standing, including filing their taxes.

Outside a TEA:
$1,050,000+

For projects situated in locations that do not meet the TEA criteria, the minimum investment required is $1,050,000. These projects often are in more economically stable or urban areas and do not qualify for the reduced investment incentive designated for TEA projects.
